Terms of Use
Last updated: 2 November 2026.
These Terms of Use (the "Terms") govern your access to and use of the Atestan application and related services (together, the "Service"), and form a binding agreement between you and Alef Global Consulting FZ-LLC ("Atestan", "we", "us", "our").
We are Alef Global Consulting FZ-LLC, a Free Zone Limited Liability Company registered in Ras Al Khaimah, United Arab Emirates (Services Licence No. 47029993), with its registered address at VUET2814, Compass Building, Al Hulaila Industrial Zone-FZ, Ras Al Khaimah, United Arab Emirates.
These Terms should be read together with our Privacy Policy, which explains how we collect, use and protect personal data, and which forms part of your agreement with us.
Please read these Terms carefully, including the disclaimers and the limitation of liability. By creating an account, enrolling a device, or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. What Atestan is — and is not
Atestan lets an authenticated organisation seal an instruction (for example a payment order, a change of bank details, a wallet address, or a request), so that a recipient can verify that the instruction genuinely comes from that authenticated issuer and has not been altered. Verification is available without an account.
The User expressly acknowledges and accepts the following limits, which are essential to the agreement:
- Atestan attests to the origin and integrity of an instruction — that it comes from an authenticated issuer and has not been modified. It does not attest that the content of the instruction is true, lawful, appropriate, or well-founded. A verified origin is not a judgment on the merits.
- Atestan is a carrier of proof, not an authority that rules on a dispute, validates a transaction, or concludes anything about the parties. The decision to act on an instruction remains entirely with the recipient.
- A result of "not verifiable" or "not found" means only that no matching seal was produced or could be checked. It does not mean that the underlying instruction is fraudulent, false, or invalid.
- Atestan reduces and makes visible certain risks of impersonation and tampering. It does not make fraud impossible, does not block any payment, and does not replace the recipient's own checks, internal controls, or professional judgment.
- The Service does not provide legal, financial, accounting, tax or other professional advice, and creates no such professional relationship between you and us.
2. Eligibility and professional use
The Service is intended for professional use by organisations and the persons they designate. You may use the Service only if you:
- are at least 18 years old and have the legal capacity to enter into a binding contract;
- act for an organisation that has been enrolled and verified as described in Section 4, or are a person duly authorised by such an organisation;
- are not barred from using the Service under any applicable law; and
- are not, and are not owned or controlled by, a person or entity subject to sanctions or trade restrictions administered by the United Nations, the European Union, the United Kingdom, or the United States (including OFAC), and are not located in a country or territory subject to comprehensive sanctions under any such regime.
3. Definitions
- Attestation (or "seal"): a cryptographically signed record binding an instruction to the authenticated identity of its issuer.
- Issuer: a User, attached to a verified organisation, who creates an attestation.
- Recipient: the person who verifies an attestation.
- Verification: the operation, available without an account, by which a Recipient checks the origin and integrity of an attestation.
- Enrolment: the operation by which an organisation and its designated persons are verified (see Section 4) and by which a device generates its signing key.
4. Account, enrolment and identity verification
Access to the issuing features of the Service requires that the organisation and its designated persons be verified once, at enrolment, through our identity-verification provider (see Section 10). This verification covers the organisation (business verification) and the designated persons (identity verification). After verification, the verified identity information is held within Atestan and is used to pre-fill, and lock, the identity fields shown when an attestation is created, so that an attestation cannot be issued under a false name or organisation.
Each designated person enrols their own device. At enrolment the device generates a signing key that is created and kept on the device and is used to sign attestations. You are responsible for keeping your device, and any credentials or biometric unlock protecting it, secure, and for all activity carried out through your enrolled device. Notify us promptly at contact@atestan.com if you believe a device or key has been lost, stolen or compromised.
5. Right to use the Service
Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the Service for your organisation's internal professional use, on a device you own or control.
This licence does not include, and you agree not to, whether yourself or through any third party:
- use the Service for any unlawful purpose, or in any manner not authorised by these Terms;
- copy, modify, translate, create derivative works from, decompile, disassemble or reverse-engineer any part of the Service, except to the extent such restriction is prohibited by applicable law;
- rent, lease, lend, sell, sublicense, distribute or otherwise make the Service available to any third party;
- remove, obscure or alter any proprietary notice on the Service;
- circumvent, disable, tamper with or interfere with any security-related or access-control feature of the Service;
- access or attempt to access the Service by any means other than the interface we provide, including by scraping, crawling, or using bots, scripts or other automated means;
- probe, scan or test the vulnerability of the Service, or breach or circumvent any security or authentication measure;
- impersonate any person or entity, or seal an instruction under an identity that is not your own or that of your verified organisation;
- use the Service to create, upload or transmit content that is unlawful, defamatory, harassing, hateful, obscene or infringing, or that exploits or endangers a minor; or
- interfere with or disrupt the integrity or performance of the Service or the data it contains.
We may investigate and take appropriate action against anyone who, in our reasonable judgment, violates this section, including suspending or terminating access and, where required by law, reporting to competent authorities.
6. Your content
You may submit information to the Service in order to seal it — for example the text of an instruction, payment details, a wallet address, or a reference ("Your Content"). You retain any rights you have in Your Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process and reproduce Your Content solely to provide, maintain, secure and improve the Service and to comply with applicable law.
Depending on the type of attestation, the content of an instruction may be encrypted on your device before transmission, so that we process a sealed record and its metadata rather than the clear content. You represent that Your Content does not infringe any third party's rights and does not violate applicable law, and that you are entitled to seal it on behalf of your organisation.
7. Intellectual property
The Service itself, and all software, text, graphics, logos, trademarks and other content we provide (excluding Your Content), together with all associated intellectual property rights, are and remain the exclusive property of Alef Global Consulting FZ-LLC or its licensors. Except for the limited licence granted in Section 5, nothing in these Terms transfers any intellectual property right to you. "Atestan" and our logos are trademarks of Alef Global Consulting FZ-LLC; you may not use them without our prior written consent.
8. Feedback
If you send us ideas, suggestions or other feedback about the Service, you agree that it is given on a non-confidential basis, and you grant us an irrevocable, perpetual, royalty-free licence to use it for any purpose, including to improve the Service, without any obligation or compensation to you.
9. Privacy
We process personal data in accordance with our Privacy Policy, which forms part of these Terms and describes the personal data we collect, the purposes and legal bases for processing, the recipients of your data, your rights, and how to exercise them.
10. Third-party services
The Service is distributed through, and relies on, the third-party platforms and providers below. Your use of those platforms is governed by their own terms and privacy policies, in addition to these Terms. We do not control, and are not responsible for, third-party services, including their availability, content or practices.
- Apple (App Store) — distribution of the iOS application.
- Google (Google Play) — distribution of the Android application.
- Didit — identity and business verification at enrolment.
- Fly.io — hosting of the Service and storage of sealed records (object storage is provided through Fly's Tigris; this is a single provider, not two).
11. Fees
Access to the issuing features of the Service is provided under a separate commercial agreement between your organisation and us. The fees, billing terms and term of that agreement are provided on a quotation basis (on request). Verification of an attestation is, and shall remain, free of charge and available without an account, on a permanent and unconditional basis.
12. Term, suspension and termination
These Terms remain in effect for as long as you use the Service. We may suspend or terminate your access, in whole or in part, immediately and without notice where required by law or where we reasonably believe you have violated these Terms, engaged in fraudulent or unlawful conduct, or created risk or possible legal exposure for us or others. Where reasonably possible, we will give notice of the suspension or termination and its reason.
You may stop using the Service at any time. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution and general provisions — will survive.
13. Changes to these Terms
We may revise these Terms from time to time, including to reflect changes in the Service, our practices, or applicable law. If we make material changes, we will notify you through the app or by other reasonable means before they take effect. Continued use after the effective date constitutes acceptance.
14. Disclaimer of warranties
To the fullest extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, satisfactory quality, fitness for a particular purpose, or non-infringement, or that the Service will be uninterrupted, timely, secure or error-free. We do not warrant that verification will detect every form of fraud or impersonation, or that it replaces your own checks and controls.
Nothing in this section limits any statutory guarantee or right that applies and that cannot be excluded under the law of your country of residence.
15. Limitation of liability
To the fullest extent permitted by applicable law, we, our officers, employees, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your access to or use of, or inability to access or use, the Service, regardless of the legal theory on which the claim is based and even if we have been advised of the possibility of such damages.
Subject to the next paragraph, our aggregate liability arising out of or relating to these Terms or the Service, whether in contract, tort (including negligence) or otherwise, will not exceed the total amount paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited as a matter of applicable law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for wilful misconduct or gross negligence.
16. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless Atestan, its officers, employees and licensors from and against any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of or connected with: (a) your breach of these Terms; (b) Your Content; or (c) your use of the Service in violation of applicable law or the rights of a third party. This section does not apply to the extent a claim arises from our own breach of these Terms, wilful misconduct or gross negligence.
17. Export control and sanctions
The Service may be subject to export control and economic sanctions laws, including those of the European Union, the United Kingdom, the United States and the United Arab Emirates. You represent that you are not located in a country or territory subject to a comprehensive embargo, and that you are not identified on any restricted-party or denied-persons list maintained by such authorities. You agree not to use the Service in any manner that would violate any applicable export control or sanctions law.
18. Force majeure
Neither party will be liable for any failure or delay in performance to the extent caused by circumstances beyond its reasonable control, including acts of God, war, terrorism, civil unrest, governmental action, internet or telecommunications failures, or failures of a third-party platform or provider referred to in Section 10.
19. Dispute resolution, governing law and jurisdiction
If a dispute arises, please contact us first at contact@atestan.com so that we can try to resolve it informally, in good faith, within a reasonable time.
These Terms, and any dispute arising out of or in connection with them or the Service, are governed by the laws of the United Arab Emirates, without regard to conflict-of-law principles, and the courts of Dubai, United Arab Emirates, will have exclusive jurisdiction, subject to the following paragraph.
Nothing in this section deprives a person who qualifies as a consumer under mandatory law of the protection of the mandatory provisions of the law of their country of residence. At our option, any dispute may instead be referred to and finally resolved by arbitration administered under the arbitration rules of the DIFC or an equivalent institution, seated in the Dubai International Financial Centre, before one arbitrator, in the English language.
20. General provisions
These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements on this subject. You may not assign or transfer any right or obligation under these Terms without our prior written consent; we may assign or transfer ours, including in connection with a merger, acquisition or sale of assets, without affecting your rights. If any provision is held invalid or unenforceable, it will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force. Our failure to enforce any right or provision is not a waiver of it. Notices to you may be given through the app, by email, or by posting on our website. These Terms are drafted in English; where a translation is provided for convenience, the English version prevails in the event of any conflict, except where a different rule is mandatory under the law protecting you as a consumer.
